            Every athlete can benefit from developing a personal brand.  Building your brand can generate networking opportunities that may lead to employment opportunities after college.  Building a personal brand can help athletes create an identity beyond their sport, so they can have an impact in their communities beyond their time as competitive athletes. 
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;span&gt;&#xD;
        &lt;br/&gt;&#xD;
        
            With all the demands on student-athletes, growing their personal brand is rarely at the top of their list.  In the past managing and growing your personal brand was something you did for fun, to stay connected with friends, family, and teammates.  Now, in the NIL universe, it is the primary way for athletes to show their value to potential partners. 
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;span&gt;&#xD;
        &lt;br/&gt;&#xD;
        
            AI is a valuable tool athletes can leverage to build their personal brand.  When using AI, it’s important to remember that human oversight is necessary to ensure that any content created is accurate and that you are not violating copyright laws. 
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;span&gt;&#xD;
        &lt;br/&gt;&#xD;
        
            Many AI tools offer free or “freemium” versions that athletes can use to grow their brand.  It is up to each individual athlete to decide how much if any, money they are willing to spend to use AI, and it does not have to cost a lot of money to use AI to build your brand. 
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
      
           That said, AI can play an important role in helping college athletes build and enhance their personal brands. Here are several ways AI can be leveraged:

            : AI tools can help athletes create consistent, on-brand social media posts. AI can analyze engagement data to determine the best times to post, what types of content perform best (e.g., videos, photos, text), and suggest relevant hashtags.

           Breaking Down Group Licensing Deals and Why Athletes Need to Fully Understand Their NIL Rights

            This week, Margaret Fleming posted an interesting article on frontofficesports.com about Vandy QB Diego Pavia and his confusion about the use of his name, image, and viral quote “Vandy we turnt " by the t-shirt company BreakingT. 
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           In a now-deleted tweet, he claimed that he did not have a deal with BreakingT and encouraged fans not to buy the T-shirts.   
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           In reality, BreakingT had every right to use Diego’s NIL.  They pointed that out in their response, letting him know that the shirts were approved and licensed by both Vanderbilt and Diego through the school's partnership with One Team Partners.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;span&gt;&#xD;
        &lt;br/&gt;&#xD;
        
            One Team Partners is a joint venture between the NFLPA and the MLBPA in 2019 and has an impressive track record. They signed a group licensing agreement with EA Sports that resurrected their College Football game, which got every player who opted in $600 and a copy of the game. 
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;span&gt;&#xD;
        
            Athletes can opt in to One Team Partners licensing agreement either individually or through their school to allow them to market their NIL rights for them.  The player is paid a royalty on any product sold.  One Team Partners fee is 30%, while the royalty paid to the athlete can vary based on their popularity.  In a 2023 article for Sportsbusinessjournal.com by Michael Smith, One Team signed a group licensing deal with Fanatics that paid a 4% royalty to the athletes for the rights to sell their jerseys. 
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;span&gt;&#xD;
        &lt;br/&gt;&#xD;
        
            We don’t know the specifics of the deal with Vanderbilt, and Diego may make a substantial amount of money from his royalties through One Team Partners.  Group licensing agreements allow schools to aggregate NIL rights for their entire program to generate passive income for their athletes.  The agreements allow for any athlete to continue to use their NIL rights individually or license them to others independent of the school. 
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;span&gt;&#xD;
        &lt;br/&gt;&#xD;
        
            Think about it.  No college athlete has the time to negotiate and close a shirt deal mid-season in just a few days, even if they have an agent and the athletic department working with them.  Yes, the athlete makes a lot less money, but that is how it works when 100% of the work is done for you. 
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           NOTE:  BreakingT posted on X that they are negotiating a direct deal with Diego, so it sounds like everything is getting worked out.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Here’s the most important point. 
          &#xD;
    &lt;/span&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;span&gt;&#xD;
        
            Diego Pavia signed a contract licensing his NIL rights to One Team Partners and didn’t know he did it.  There are plenty of reasons why.  We have all signed documents we didn’t read.  Does anyone read the Terms of Service that pop up constantly on your devices?  No.  We just sign them. 
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;span&gt;&#xD;
        &lt;br/&gt;&#xD;
        
            For NIL deals, you can’t just scroll to the bottom and sign.  Athletes need to slow down, ask questions, and ensure they understand what they are signing, even if it’s a document the school is asking them to sign.  It is perfectly acceptable to ask for time to read documents and ask for advice before signing.  For schools, this is a reminder that they must educate athletes beyond the basics of financial literacy, and make sure they have a process in place to teach them as much as they want to learn about all aspects of NIL, including topics like what it means to sign a group licensing agreement. 
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;

           If you are a comic book nerd like me, you love a good origin story. You get to see the seminal event that causes an ordinary person to become a hero or a villain. In business, it’s that light bulb moment when an idea hits you, and motivates you to create the solution to fulfill the needs of the consumer.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           In both cases, the origin story is the foundation of what happens next.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           As an athlete, your origin story is the foundation of your personal brand. Your origin story is the narrative of how you became who you are today. It defines your identity, shows your motivation, highlights your passion, humanizes your brand, and facilitates an emotional connection with your audience.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           So how do you create an origin story? Let’s take a look at the steps you should follow:
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;ol&gt;&#xD;
    &lt;li&gt;&#xD;
      &lt;span&gt;&#xD;
        
            Reflection: What sparked your interest in sports? Was there a pivotal moment that let you to pursue a specific path? Take some time to think about these questions and write down your thoughts.
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/li&gt;&#xD;
    &lt;li&gt;&#xD;
      &lt;span&gt;&#xD;
        
            Obstacles: What challenges did you face along the way? Overcoming adversity is often the most engaging aspect of your story.
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/li&gt;&#xD;
    &lt;li&gt;&#xD;
      &lt;span&gt;&#xD;
        
            Mentors: Who are the people who played a significant role in your journey? Paying homage to your mentors can inspire others to seek guidance as well.
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/li&gt;&#xD;
    &lt;li&gt;&#xD;
      &lt;span&gt;&#xD;
        
            Share Your Victories: What have you achieved as an athlete and as a person?
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/li&gt;&#xD;
    &lt;li&gt;&#xD;
      &lt;span&gt;&#xD;
        &lt;span&gt;&#xD;
          
             Lessons Learned: What lessons did you learn from your experiences? How have they molded your attitudes, work ethic or approach to competition?
            &#xD;
        &lt;/span&gt;&#xD;
      &lt;/span&gt;&#xD;
    &lt;/li&gt;&#xD;
  &lt;/ol&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           As you can probably guess, this process can take some time. But answering these questions will help you create an origin story that will allow you to define your unique, personal brand. Once you complete your origin story you can share it with others through social media to offer support and inspire others facing similar challenges. You can use it as self-motivation during challenging times to remind yourself of how far you’ve come and the strength you possess.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           And finally, your origin story creates a sense of authenticity for you and can create an instant emotional connection with your audience. This makes your journey unique and highlights what makes you stand out from the rest.

      <title>NIL's Litigation Era Has Begun</title>

           Broken promises and dissatisfied sponsors are going to force courts or Congress to make decisions for the NCAA

&lt;/div&gt;&#xD;
&lt;div data-rss-type="text"&gt;&#xD;
  &lt;h4&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Matthew Sluka, the starting quarterback for the undefeated UNLV football team, announced last night on X that he was leaving the team, effective immediately.  In his post, he makes it pretty clear that his departure is due to unfulfilled NIL promises that were made to entice him to transfer from Holy Cross.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/h4&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           On X Sluka states “I committed to UNLV based on certain representations that were made to me, which were not upheld after I enrolled.  Despite discussions, it became clear that these commitments would not be fulfilled in the future.”
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;span&gt;&#xD;
        &lt;br/&gt;&#xD;
        
            This is not the first time an institution has overpromised and underdelivered.  The next announcement will likely be the filing of a lawsuit against UNLV and any other parties involved. 
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;span&gt;&#xD;
        
            In the unregulated, wild, wild west of NIL, this is the logical next step in its evolution.  Unhappy players are going to sue the school, unhappy corporations are going to sue the athletes. 
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
      
           The Litigation Era for NIL has begun, and until Congress or the NCAA can figure out a solution, I doubt it will end anytime soon.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;

           Reggie Bush Sues USC, PAC-12, NCAA
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/h4&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Bush is seeking NIL reimbursement while he was a member of the Trojans. After the recent reinstatement of his Heisman, Bush’s relationship with USC had warmed, but the financial impact of the 2004 sanctions cannot be denied.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;h4&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Brandon vs. NC
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/h4&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           The North Carolina Board of Education is now considering new rules in light of the recent lawsuit filed against their policy of prohibiting NIL compensation for high school athletes. The new rule would allow student-athletes from grades six through twelve to receive compensation from various sources, including public appearances, autograph signings, and social media.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;h4&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Fanatics vs. Marvin Harrison Jr.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/h4&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Fanatics claims Harrison Jr. agreed to provide the company with memorabilia and apparel, something Harrison Jr. disputes, claiming he did not sign the contract, and instead signed with The Topps Company. Fanatics has added Marvin Harrison Sr. as a defendant, alleging that he misled Fanatics into believing that his son had signed the contract.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;h4&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Jaden Rashada vs. University of Florida
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/h4&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           The University of Georgia QB has sued the University of Florida, Head Coach Billy Napier, and UF booster Hugh Hathcock, stating his argument that they fraudulently induced him to forfeit a $9.5 million NIL deal with the University of Miami. Rashada and his attorneys are accusing the UF Collective of a “bait and switch” tactic by offering over $13 million over four years as an enticement to come to UF, then failing to honor the agreement.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;h1&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Federal Legislation Update
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/h1&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Although several bills have been introduced since the inception of NIL, there has been little to no movement by either chamber to move forward. With the election less than two months away and much more pressing issues facing Congress, you can expect there will be no conversation around student-athlete compensation until after the new session starts in 2025. Much like the NCAA, Congress has been reticent to act while they wait to see the outcome of multiple legal cases. If the House vs. NCAA settlement does get approved, you may see Congress become more involved in creating a national legal standard.
          &#xD;

      <title>The Next NIL Market:  High School Athletes</title>

           For the past month, I’ve been following the news about five-star shooting guard Darryn Peterson and his decision on where to play college basketball for the coming academic year. In July, Rivals Rob Cassidy on nbcsports.com ranked Kansas as the most likely landing spot, pointing out the strong relationship between the player and the coaching staff. He also noted that Peterson had signed a major NIL deal with Adidas last November, which also happens to be a major sponsor of the Jayhawks.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
      
           That reminded me of an article I read by Jon Conahan on SI.com about how important NIL is in Peterson’s decision-making process. He points out that a big part of why Peterson transferred from Cuyahoga Valley Christian Academy after his sophomore year was because NIL for high school athletes is prohibited in Ohio. By transferring to Huntington Prep in West Virginia, he could legally sign the NIL deal with Adidas.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
      
           Then news broke that the mother of five-star quarterback Faizon Brandon is suing the North Carolina State Board of Education and its Department of Public Instruction for enforcing a ban on public high school student-athletes profiting from their Name, Image, and Likeness rights, a policy they adopted beginning in June 2024.  The ban only applies to public school athletes, so top recruits at private schools can leverage NIL deals to make money before they commit to a college. 
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
      
           These are just the first examples of the new landscape rapidly approaching high school athletic programs. A little over 20 states prohibit high school athletes from signing NIL agreements. Most states have passed the buck to the high school sports associations or governing bodies to try to regulate NIL in high school. Cases like Faizon Brandon illustrate the current inequity and inconsistency.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
      
           Managing this will be far more complex than at the collegiate level. Local high school Athletic Directors do not have the money or the resources to educate their athletes on the risks of NIL contracts. Also, high school athletes are minors, so what role do their parents play? Who’s responsible for fulfilling the contract? Is it possible to have a Collective for a high school athletic program? The more you think about it, the more questions arise.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
      
           Finally, don’t forget that Darryn Peterson transferred to a school where he could sign an NIL deal. Good for him. For coaches, though, not so great. With NIL now as an option to fund tuition costs at private schools, who’s to say what will happen with the top talent at local public high schools?  For every elite athlete who can sign with Adidas, dozens more could sign deals with local companies. Can the local private school alumni sign the public high school football star to play for their alma mater? Who knows.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
      
           NIL has opened up doors for college athletes across the country. It also has widened the funding gap between the top programs in the country and everyone else. Three years in, most college athletes do not have access to the same support and resources as athletes at elite Power 5 programs. And even at these schools, most of the NIL money goes to the top athletes in the top money-making sports. The impact of NIL at the high school level could be even greater, as high school athletic programs aren’t designed to make money. Ultimately, you could see the top public school talent be siphoned off into private school programs.

  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;span&gt;&#xD;

           If you work in digital advertising, this shift is nothing new. We’ve seen it play out before. As the early 2000s ushered in the first wave of social media and user generated content, so too it created an influencer marketing industry dominated by each platform’s biggest stars.
